Things that acting President Ruto Can and Can not do

Uhuru Kenyatta handed over power to his deputy William Ruto hours before he traveled to the Hague. Many Kenyans are wondering what Ruto can or can not do while on acting capacity

The authority of ‘President Ruto’ :

Since that minute when Uhuru Kenyatta handed over power to William Ruto, he (Ruto) is now the head of state and government. He is also the Commander in Chief of the KDF (Kenya Defense Forces) and the chair person of the Kenya Security Council.

However, there is a limit to what ‘President Ruto’ can and can not do.

What William Ruto can not do while on acting capacity:

He is not able to nominate or appoint judges of the superior courts. He also can not appoint or nominate ANY public official. Also, William Ruto can not nominate, appoint or dismiss cabinet secretaries and other state or public officers, including various diplomatic representatives.

The ‘acting President William Ruto‘ can not exercise the power of mercy. This means that he can not pardon people who are convicted of various offences or reduce their sentences. He also can not confer honors in the name of the people and the republic

What the acting President can do :

William Ruto can address parliament ANY times he wishes. He can also chair cabinet meetings and direct/ coordinate government departments and ministries.

The acting president is also able to receive foreign diplomatic and consular representatives

According to article 58, the acting president can declare a state of emergency and with the approval of parliament, he can declare war if need be.
