Retired judge Benna Wamukoya Lutta Compensated 883 million shillings for wrongfully eviction from his land in Kitale
For the last three decades, Judge Benna Wamukoya Lutta has been persuing what he terms rightfully his. His trouble started back in 1983 when the state invaded his farm and evicted him his family and workers before occupying it.
During the eviction, his property including farm equipment, crops and livestock were destroyed. His efforts to get legal reprieve proved futile as police failed to enforce court orders requiring them to eject the invaders. Instead, the government constricted a police post, a chief’s office and two schools on the said land. All this was done without considering any compensation to Lutta
Today, the retired judge was awarded Sh 850 Million for the loss of his 1,756 acres of land, Sh 30 million for the destruction of his property and Sh 3 million in general damages, all totaling to Sh 883 Million.
Lutta had originally sought Sh 1, 078,000,000 (one billion, seventy eight million shillings) in compensation
