High court nullifies mobile traffic courts and new traffic rules

The high court has nullified mobile courts and new traffic rules that were outlined by transport CS Michael Kamau and the NTSA. The regulations have been termed as unlawful

The court said that Engineer Kamau can only purport to implement that which is lawful. It emphasized that for the CS  to come up with regulations, the rules should first be taken to parliament for scrutiny before implementation

The case had been filed by the Kenya Country Bus owners association which has contested the new traffic rules. The court said that regulation 11 of the legal notice of 2014 which ordered the removal of rooftop carriers from pubic transport vehicles by the NTSA and CS for transport is null and void

The court also ordered NTSA (National Transport and Safety Authority ) to return PSV licenses and number plates removed from vehicles

The mobile courts that were set up by NTSA on major roads across the country have also been suspended. This was said by chief justice Willy Mutunga. He said that the move was prompted by an outcry from members of the public. He also alleged that there was rampant fraud and corruption at the said mobile courts
