Court orders KNEC to change Audrey Mbugua’s certificate
The Kenya National Examination Council (KNEC) has been ordered by the court to change Audrey Mbugua’s high school certificate to recognize her new name.
KNEC has 45 days to provide a new KCSE certificate to her. Audrey was born male but was later diagnosed with a gender identity disorder. She is still undergoing treatment for the condition
The court also ordered KNEC not to include “gender” in her certificate since the law does not require the gender mark on a certificate. the Examinations Council was prudent about amending Audrey’s certificate, arguing that they had no evidence as to whether the transformation from male to female had been done successfully.
Audrey told the court that KNEC should accept her condition because other government organizations like HELB and the Department of immigration had accepted her new gender
While issuing the orders, Justice Korir said that Audrey is entitled to human dignity which should not be contravened through humiliation or dehumanization
